Making your Will and Power of Attorney

Wills, Powers of Attorney and Probate is what we do.  We do it because we really like it, which means we’re good at it.

Our job is to work with you to create a Will which not only  reflects  your wishes today, but also in the future.

Your Will is an  important document as it allows people to understand your intentions and wishes concerning your money, home, children, pets, superannuation and even your funeral after you have passed.  Young people in particular often ask if they need a Will, and the answer is yes, yes and yes!  If you are 18 years old or older and pass without a Will it means you die  “intestate” and your money or home could be distributed according to the laws of the state and not your wishes.  It’s our job to help you make sure that this does not happen.

When you are making your new Will it’s a good time to think about a Power of Attorney (POA) and Appointment of Medical Treatment Decision Maker (AMTDM) documents.  Both POAs and AMTDMs are important documents and should be contemplated with serious consideration as to the appointment of the attorney and medical decision maker or makers. More and More these days hospitals and aged care facilities are asking for AMTDM prior to entering the facility and unfortunately a person cannot make either a POA, AMTDM or a Will if they lack testamentary capacity to do so.
